1 inye lianeha liguan he}inye shenPan」iguan林业检察机关和林业审判机关(fo哪trypIDcu~al0嗯ans andfo沈stry courts)设置在林区或专门管辖林业(或林区)案件的检察和审判机关，是保护、发展和合理利用森林资源、维护林区秩序的一支重要执法力量，是国家检察机关和审判机关的重要组成部分。它是为保卫森林资源安全和维护林区社会秩序的需要而建立的。1980年12月l日，林业部、公安部、司法部、最高人民检察院联合发出通知，要求在重点林区建立健全的林业公安、检察、审判机关。1981年中共中央、国务院发布的《关于保护森林发展林业若干问题的决定》再次重申要在林区抓紧建立健全的林业公检法机构。黑龙江、吉林、四川等省首先响应，相继组建了省地县级的林业公安处(局、科、股)、林区检察院和林区法院;之后一些大型国有林区，如大兴安岭林区、甘肃省白龙江和子午岭林区等也相继组建了林业检察机关和林业审判机关;最后南方集体林区在重点林业县也分别在当地的检察、审判机关内部设置了林业检察科(室)或林业审判庭。林业检察机关和林业审判机关根据其业务性质和收案范围还可以分为林区检察机关、林区审判机关和林业检察机关、林业审判机关两种。林区检察机关和林区审判机关根据批准设立的人民代表大会或者其常委会的批准或授权，行使地方同级检察机关和审判机关的职权，即林区检察院和林区法院，其收案范围是林区内所有归检察机关和审判机关管辖的案件，包括刑事、民事、行政、经济案件等。林业检察机关和林业审判机关则是在重点林区的省、地、县检察院、法院内部设置的林业检察处(室)和林业审判庭，其收案范围仅限于特定的林业案件或与林业有关的案件。一般情况下，林区和林业检察机关、审判机关均统称为林业检法机关。林业检察机关和林业审判机关在实际工作中，严格依法办事，分别采取严打、集中专项治理等措施，狠狠打击各种毁林行为，并深人基层，广泛开展法制宣传，在保护森林资源安全和维护生态环境方面发挥了重要的作用。到目前为止，全国共有林业检察机构240多个，从业人员3 300多人;林业审判机构269个，从业人员32(X]多人。 (王洪杰)
