水利工程占地补偿
水利工程占地补偿建设防洪、除涝、灌溉、供水、水力发电等水利工程所占用土地和工程淹没用地，致使土地所有单位及使用者个人在该土地上的经营利益和财产受到损失，根据国家法律、法规和有关经济政策，给予土地所有者和使用者个人以合理的货币和实物补偿。水利工程占地补偿以恢复受损失经济对象的实物数量和质量标准为度，或以实现其原有的经济利益并留有发展余地为度，使被征地单位和移民个人财产不受损失，并得以利用补偿费用和实物尽快恢复生产，保证生活。中国政府对土地征用和移民安置十分重视，早在1953年12月10日政务院就公布了国家建设征用土地办法，规定了有关土地征用程序、土地补偿以及被征用土地者的安置等政策。国务院于1958年1月6日重新修订了这一办法，到1982年5月14日国务院又公布了国家建设征用土地条例，明确提出了节约土地是中国的国策，补充修订了征用土地的程序、批准权限，调整了土地征用费用，明确了移民安置的方向和途径。1987年1月l日开始实施的《中华人民共和国土地管理法》规定，国家建设征用土地，需由用地单位支付土地补偿费和安置补助费。1991年2月1日国务院发布的《中华人民共和国土地管理法实施条例》又进一步作了更详细的规定。此外《中华人民共和国水法》也对此作出了规定。以上这些规定、办法都适用于水利工程建设。与此同时，1991年5月1日开始实施的由国务院发布的《大中型水利水电工程建设征地补偿和移民安置条例》对水利工程占地补偿作出了更为详细、更为具体的规定。如条例第五条规定，大型水利水电工程建设征用的土地，由建设单位按下列标准支付土地补偿费和安置补助费:①征用耕地的补偿费，为该耕地征用前3年平均年产值的3倍至4倍;每一个需要安置的农业人口的安置补助费标准，为该耕地被征用前3年平均每亩年产值的2倍至3倍。大型防洪、灌溉及排水工程建设征用的土地，其土地补偿费标准可以低于上述土地补偿费标准，具体标准由水利部会同有关部门制定。②征用其他土地的补偿标准和安置补助费标准由省、自治区、直辖市政府参照《条例》的标准规定。
