《劳动合同法》虽然针对当前劳动用工领域存在的不良现象,通过完善无固定期限劳动合同制度,加大了对劳动者的保护力度,体现了以“保护劳动者合法权益”为核心的立法宗旨,但仍然还存在很多不明确的地方,如有关合同订立的条件、形式和适用主体的规定以及合同解除的条件、程序和法律后果的规定都有很多漏洞,致使在实践中引起不少争议,使得无固定期限劳动合同虚化和劳动合同短期化现象严重的问题也仍然难以得到有效解决。

《中华人民共和国劳动合同法》(以下简称劳动合同法)于2008年1月1日起施行,这部法律是规范企业和劳动者之间订立、履行、变更、解除和终止劳动关系的法律,贯穿于人力资源管理活动的整个过程。

【保险合同法】调整保险合同双方权利义务关系的法律规范的总称,是保险法的重要组成部分。在西方国家,保险法可分为保险私法和保险公法,保险合同法属于保险私法范畴。我国的财产保险合同属于经济法调整的范畴。保险合同法一般包括调整财产保险合同与人身保险合同的法律、法规。由于历史原因,海上保险合同通常单独立法或规定在一国的海商法中。还有一些国家将简易人寿保险单独立法。 保险合同法一般包括订立原则、合同的订立、变更、停止、解除、转让以及合同双方的基本权利和义务、合同争议的解决等内容。《中华人民共和国经济合同法》中关于财产保险合同的规定、.《中华人民共和国财产保险合同条例》是我国现行的关于财产保险合同方面的法律、法规;《中华人民共和国海商法》中关于海上保险合同的规定,是我国的海上保险合同立法。目前,我国尚没有人身保险合同方面的法律、法规。
