| 法律关系 legal relation 由法律规范所确认和调整的人与人之间的权利和义务关系。其构成要素是：①参与法律关系的主体——简称为权利主体。②构成法律关系内容的权利和义务。③法律关系主体间权利和义务所指向的对象——简称为权利客体。 法律关系与法律规范有着不可分割的联系。因为法对社会关系的调整，是通过制定各种法律规范以及实施这些法律规范来进行的。法律规范为人们设定不同的权利和义务，并且由国家强制力保证这种权利的行使和义务的履行以实现对人们行为的调整作用。所以任何一种法律关系都以与这一法律关系相适应的现行法律规范为前提 。如果某种社会关系（如友谊关系、恋爱关系）没有法律上的规定，那么就不是法律关系，不具有法律上的权利和义务的性质。另一方面，法律规范只有在具体的法律关系中才能得以实现，才能对社会生活起调整作用。一般来说，法律规范本身并不直接导致具体的法律关系的产生、变更或消灭，只是为这种关系的产生、变更或消灭提供了一种模式，只有当作为法律规范适用条件的法律事实出现时，才引起具体的法律关系的产生、变更和消灭。 一切法律关系都具有意志关系的性质。因为：①任何法律关系中都表现着统治阶级的意志。法既然是以国家意志形式表现出来的统治阶级的意志，那末，一切法律关系就不能不受统治阶级意志的制约。②每一具体的法律关系，通常总是通过该法律关系的所有参与者或其中一方的意思表示而产生的，即使有某些情况是由于某种法律文件的规定或某一事件的出现而产生的，这一法律关系中所确定的权利和义务，也必须通过该法律关系参与者的意志行为才能完成。 |
