Available evidence can't yet prove the behavior of ex-lawyer Bao Yuming constitutes sexual assault, according to a thorough investigation into sexual assault allegations against Bao.

The results of the investigation, supervised by a team from the Supreme People's Procuratorate and the Ministry of Public Security, were released on Thursday.

Bao came into the spotlight in April when a woman surnamed Han claimed Bao had started sexually assaulting her around 2016 when she was 14 years old.

The woman's allegation triggered nationwide attention and a supervision team was dispatched to Shandong province, where the case originated, to supervise the local investigation.

The results released on Thursday detailed the basic information of Bao and Han, their relationship, the sexual assault allegations and possible misconduct of local police authorities in handling the case.

Meanwhile, the Ministry of Public Security decided to deport Bao, who is a US citizen and violated China's regulations on exit and entry administration during his stay in the country.

Bao was also deprived of his lawyer's practice certificate by the Beijing Bureau of Justice due to serious violation of relevant laws and regulations on legal practice.

Han's age

In March 2015, Han and her father provided false birth certificates and witness testimony to apply for changing their date of birth.

After reading Han's school registration materials and historical files, asking their relatives, classmates, neighbors and other insiders, and examining Han's bone age identification results, it was found that Han was born in October 1997.

The two's relationship

The two actually lived together for more than 150 days, and had many conflicts due to emotional problems.

During their time together, Bao did not know Han's real age.

According to information from the civil affairs department, the two did not meet the legal conditions for adoption, did not go through the adoption procedures and there was no adoptive relationship between them.

Sexual assault charge

There is no evidence suggesting Bao violated the will of Han and forced her to have sex with him by violence, coercion or other means.

Han met Bao at the age of 18, therefore she was not a juvenile under the protection of the law. 

During their time together, Han was free to move and keep normal communication with her family and friends. There is no evidence suggesting she was controlled by Bao or lost her freedom of action.

Bao and Han had a cohabitation and sexual relationship, but the existing evidence cannot prove Bao committed sexual assault.

The dealings on involved authorities

Local authorities violated rules in dealing with Bao and Han's case by showing bad and negative attitudes, and they have been urged to reform.

Relevant people involved in the case of Han illegally changing her age have also been dealt with.
