第八章 专利登记和专利公报

Rule 88 The Patent Administration Department under the State Council shall keep a Patent Register in which the registration of the following matters relating to patent application or patent right shall be made:

(3) registration fee for the grant of patent right, printing fee for the announcement of grant of patent right, maintenance fee for application, and annual fee;
（三）专利登记费、公告印刷费、申请维持费、年费；

The transfer, cancellation, invalidity, termination of patent right and the information such as change of patentee's name, nationality or address etc. is recorded in the Patent Registration.
专利权的转让、撤销、无效、终止和专利权人的姓名、国籍、地址变更等事项记载在专利登记薄上。

Any cessation of the patent right shall Be registered and announced by the Patent Office.
专利权的终止,由专利局登记和公告。

Only when everything is ok will the patent is registered.

The decision revoking the patent right shall be registered and announced by the Patent Office.
撤销专利权的决定，由专利局登记和公告。

The decision declaring the patent right invalid shall be registered and announced by the Patent Office.

Any cessation of the patent right shall be registered and announced by the Patent Administration Department Under the State Council .
专利权在期限届满前终止的，由国务院专利行政部门登记和公告。

The decision declaring the patent right invalid shall be registered and announced by the patent administration department under the State Council.
宣告专利权无效的决定，由国务院专利行政部门登记和公告。

The assignment shall take effect as of the date of registration.

If the applicant does not go through the formalities of registration within the time limit, he or it shall be deemed to have abandoned its or his right to obtain the patent right.
期满未办理登记手续的，视为放弃取得专利权的权利。

If the applicant completes the formalities of registration within the said time limit, the Patent Administration Department under the State Council shall grant the patent right, issue the patent certificate and announce it.
申请人按期办理登记手续的，国务院专利行政部门应当授予专利权，颁发专利证书，并予以公告。

"Where the right to apply for a patent or the patent right is assigned, the parties must conclude a written contract, which will come into force after it is registered with and announced by the Patent Office. "
转让专利申请权或者专利权的,当事人必须订立书面合同,经专利局登记和公告后生效。
18.
The decision made by the Patent Office granting a compulsory license for exploitation shall be registered and announced.
专利局作出的给予实施强制许可的决定,应当予以登记和公告。
