The theory of subordinate accomplice believes that the punishment of the narrow accomplice is dependent on the behavior of the actor on the base of theory of benefit violation,while the theory of independent accomplice holds that the abettor should be punished according to the criminal conduct.
按照传统大陆法系共犯论中的从属性与独立性的含义,从解释论的角度来看,我国刑法中规定的教唆犯符合共犯独立性说,从立法论的角度,共犯从属性说的主张更为合理。
