We analyse all kinds of systems to obstruct migrant peasant workers’ employment and living to city, discuss legal solutions to establish and improve new system and drive migrant peasant worker to employ and live in city,and propose suggestions on forming legal setup to guarantee peasant workers’ employment and living in city.

This article explored the factors which influence the rural-urban labor migration of rural households in China by using the data drawn from survey of Henan Province and employing the binary Probit method.
