意见证据规则是英美证据法上规范证人证言的证据规则,英美法系国家将证人分为普通证人与专家证人,并规定一般情况下,普通证人只能陈述自己亲身经历的事实,不得发表以其直接观察得出的推断或意见,否则证言因不具有可采性而被排除:而专家证人由于具有专门性的培训知识和技能,在推断结论时有确定性的证据,所以专家以意见或推论的形式所作的证言通常被采纳。
