In order to provide the rescuer not only moral evaluation and praise but also legal remedies, the author prefers to employ the standardized legal language - \'acts of jeopardy rescue\' to replace the widely discussed \'being ready to help others for a just cause\' in jurisprudential circle to defer from the \'being ready to help others for a just cause\' in morality.
笔者拟用规范的法律用语——“危难救助行为”来替代目前法学界广泛讨论的“见义勇为行为”,以区分于道德规范中的“见义勇为行为”,避免仅对“见义勇为行为”做道德评价和精神褒扬,而物质救济不足,实现法律对“危难救助行为”的规范、调整和保护,从而为危难救助者提供有效的救济途径,更好地保障其合法权益。

Behaving righteously can be classified into two kinds: One is the action of rescuing and the other is the restriction of tort.
见义勇为行为分为救助行为与对侵权行为制止两类,对第一类见义勇为行为予以法律的保护均无异议,但对于第二类见义勇为行为则存在见义勇为造成新的损害赔偿问题和见义勇为行为合法性的问题,故对见义勇为行为应首先进行分类和定义,做到对见义勇为者的合法权利进行有效的保护,杜绝见义勇为行为的滥用,防止公众对公众权力救济信心的丧失和影响我国建设法治社会的进程。

刑法学角度的论述,着重对目前世界上与不真正不作为犯作为义务来源的相关刑事制度以及刑法学说史予以评述,从而得出对将见危不救行为作为一种不真正不作为犯罪予以刑事处罚的否定态度;法经济学角度的论述,通过运用图表阐明犯罪收益与犯罪成本对犯罩概率的影响,从而得出设置"见危不救罪"将使该"罪"的犯罪收益与犯罪成本的比值处于非正常状态,最终将引起"见危不救罪"急剧飙升的结论。
