| 累犯 recidivist 曾犯判处有期徒刑以上刑罚的罪，服刑完毕或被赦免后，在5年以内又犯应判有期徒刑以上刑罚的罪的罪犯。构成累犯必须具备4个条件：①前罪必须是被判处有期徒刑以上的故意罪。如前罪只被判处拘役、管制或其他独立适用的附加刑，或只是过失罪，即使再犯重罪，也不构成累犯。②前罪所判的刑罚必须执行完毕或执行一部分而被赦免后再犯罪的。被判处死刑或无期徒刑的，不发生累犯问题。但如被判处死缓或无期徒刑被减为有期徒刑并执行完毕或被赦免后再犯罪的，仍可构成累犯。③后罪也必须是被判处有期徒刑以上刑罚的故意罪。④自前罪刑期执行完毕或执行一部分后被赦免之日起，在法定期限内再犯罪的。中国刑法规定法定期限为5年。被假释的犯罪分子，期限从假释期满之日起计算。被判处有期徒刑宣告缓刑的犯罪分子，在缓刑考验期满后5年内，犯应当判处有期徒刑以上刑罚之罪的，也构成累犯。危害国家安全的犯罪分子在刑罚执行完毕或被赦免以后，在任何时候再犯危害国家安全罪的，都以累犯论处。中国刑法规定，对于累犯应从重处罚（见量刑）。 |
