人民检察院在人民法院宣判前变更起诉、追加起诉、撤销起诉的权利：在人民法院宣告判决前，人民检察院发现被告人的真实身份或者犯罪事实与起诉书中叙述的身份或者指控犯罪事实不符的，可以要求变更起诉；发现遗漏的同案犯罪嫌疑人或者罪行可以一并起诉和审理的，可以要求追加起诉；发现不存在犯罪事实、犯罪事实并非被告人所为或者不应当追究被告人刑事责任的，可以要求撤回起诉。《人民检察院刑事诉讼规则》第351条
