| 特赦 pardon 赦免的一种。对受罪刑宣告的特定犯罪人免除其刑罚执行的制度。与大赦不同。特赦的特点是：①只对特定犯罪人实施，不是对某一种类的犯罪实施。②只免除刑罚的执行，不能使罪、刑归于消灭。③在犯罪人罪行宣告之前，不能撤销其刑事追诉。通常由国家元首或国家最高权力机关以命令方式实施。中国1982年宪法规定，特赦由全国人民代表大会常务委员会决定，由中华人民共和国主席发布特赦令。
