承租人要求出租人承担例外情况的瑕疵担保责任的权利：《合同法》的224条规定：“租赁物不符合约定或者不符合使用目的，出租人不承担责任，但承租人依赖出租人的技能确定租赁物或者出租人干预选择租赁物的除外，依此规定在例外的情形下出租人的瑕疵担保责任不能免除。由于融资租赁合同的出租人是以融物的形式向承租人提供融资的，其主要义务是出资购买租赁物提供给承租人使用、收益，基于买卖合同产生的权利、义务，除由出租人承受支付货款和取得标的物的所有权外，其余几乎全由承租人承受，所以融资租赁的出租人对于标的物的瑕疵不宜负担保责任，在一般的条件下，合同中有对出租人的“瑕疵担保免责条款”。《合同法》第244条
