| 社会保障 social security 国家和社会依法对社会成员的基本生活予以保障的社会安全制度。劳动者在丧失或中断劳动能力，以及遭受各种风险而不能维持最低水平的生活等情况下，有从国家和社会获得物质帮助的权利。为社会成员提供生活保障是国家和社会应尽的责任。社会保障一词最早出现于美国国会1935年颁布的《社会保障法》。社会保障的内容各国不尽相同，中国学术界对此也有不同的看法。一种意见认为，社会保障包括社会保险、社会救助和社会福利3部分。社会保险是对未来风险的预防，社会救助是对现实贫困的救济，社会福利是提供福利设施和社会服务。也有持异议者，认为社会保障与社会保险、社会救助、社会福利、优抚安置同为社会工作的主要内容。 社会保障制度的模式有：①就业保障制。对工薪者实行的社会保险。规定受保人享受退休金和其他保障的标准，取决于就业的年限和交纳保险费时间的长短，其中工伤保险和家庭津贴则取决于是否存在受雇关系。基金来源于雇员和雇主按工资的一定比例交纳的保险费，国家酌情给予一定补助。②普遍保障制。对全体居民或公民，不论其收入多少、有无收入或是否就业，都提供平均水平的现金补助。所有达到规定居住年限的居民都可通过申请享受诸如养老金、伤残抚恤金、遗属及孤儿抚恤金、家庭津贴等待遇。③以家庭经济调查为基础的社会救助。由政府制定一个最低生活需要标准，即贫困线，通过调查家庭和个人的经济来源及状况，根据标准决定是否给予社会救助。这属社会救济计划，资金来源于国家财政。④储蓄基金制。由政府通过立法强制实行。雇员和雇主按工资的一定比例交纳相应金额作为专用储蓄基金，当发生规定的保险事故时，将这笔专用基金连本带息一次性支付给受保人。国家不提供资金，但在政策及税收上给予优惠，并对这笔积累起来的基金通过营运使之保值和增值。这属“自助式”或“自供型”的社会保障模式。⑤雇主责任制。国家通过立法，通常是劳动法，强制雇主在其雇员遭受某些特殊事故如工伤事故时，提供专门的补助金，向被解雇的雇员支付解雇赔偿金，对老年职工提供一次性退职金。这属比较古老的雇主责任保险，现已逐步向社会保险转变。 社会保障的管理体制大体可分为集中统一管理、多部门分散管理两大类。社会保障对社会发展的作用主要是：通过提高劳动者的素质或劳动力再生产的质量，保证社会再生产正常进行；为自由劳动提供条件，促进产业结构的调整和商品经济的发展；引导消费投向，调整消费结构，变消费基金为建设资金，抑制消费膨胀，推动生产发展；创造一个民主、和谐、安定的社会环境，使社会得以协调发展和良性运行。 |
