t保险代理的授权委托书l‘委托代理是基于因被代理人的委托授权而产生的代理。因此，代理人与被代理人就代理关系达成协议后，授权委托人就应进行授权。保险代理的授权属保险公司的单方法律行为。保险代理人在授权范围内，为保险公司代办保险业务，保险代理人的代理行为所产生的权利和义务，都由保险公司享有和承担。委托代理的形式有口头和书面两种，但由于保险代理涉及面广，代理人的代理行为影响着保险人、投保人、被保险人及自身的利益，因此，为了更好的明确代理人与被代理人的权利与义务，法律规定保险代理授权应当采用书面形式，如保险代理授权委托书，保险代理证书等形式。保险代理人只要向第三人出示保险代理授权委托书或保险代理证书，即可表明其所具有的代理权限。 保险代理授权委托书必须载有法定记载事项，以明确其权限范围及其它必要事项，这些法定事项主要有:(l)代理保险业务的范围;(2)保险代理的权限范围;(3)保险代理权的有效期限;(4)保险代理人的名称或姓名。另外，保险代理授权书还应有授权保险公司的签名或盖章。 保险代理授权委托书务必要做到授权明确，若委托书授权不明，而导致了代理人的错误行为，由此而导致第三人损失的，则应由保险人向第三人承担民事责任，代理人也要付连带责任。也就是说，如果因委托授权不明确，给投保人被保险人造成了损失，投保人、被保险人有权向保险人请求赔偿。保险人在对被保险人清偿债务后，有权向代理人追偿。由此可见，保险人与代理人间的责权分明与否，关键在于授权委托书的授权明确程度。
