| 抵押 pledging 债的担保方式。债务人或第三人提供一定的财产作担保，当债务人不能履行还债义务时，债权人有权依照法律的规定变卖抵押物优先受偿。抵押物一般是易于保存和变卖的有形财产，如有价证券、房地产、商品提单、票据等；也有以无形财产作为抵押物的，如采矿权、典权等。银行一般只接受容易在市场上流通和变卖的财产、权力作为抵押物，以保证其债权及时得到实现。抵押物可由抵押权人占有，也可以由抵押人占有。不动产作为抵押物时一般不转移占有，抵押人仍享有占有、使用、收益的权利，但必须妥善保管，当遇到第三人对抵押物进行追索时，抵押人应将情况及时通知抵押权人。抵押人对抵押物进行处置时，必须征得抵押权人的同意；抵押人变卖抵押物时，抵押权人有优先的购买权。当抵押物由抵押权人占有时，抵押权人只有保管的义务而没有使用的权利，但有权请求抵押人偿还为保管所支出的费用。 |
