stress crime
应激性犯罪(stress erime)行为人在应激状态下产生的犯罪行为。应激状态是主体在出乎意料的紧迫情况下所产生的高度紧张的情绪状态。应激犯罪有两种情况:(l)故意犯罪动机的转移。犯罪者在实施犯罪过程中遇到受害者的反抗或面临被抓获的危险时，突然产生的攻击性暴力行为，使犯罪向恶性发展，由第一犯罪动机转移到第二、第三犯罪动机。(2)行为人在应激状态下手足无措而造成过失犯罪。如汽车司机高速行车突遇行人无法躲避而造成的交通肇事犯罪。应激犯罪的特点是:(l)犯罪人在应激状态下作案，感知、记忆、思维有误，行为失措，常留下漏洞和破绽，作案后难回忆作案细节。(2)应檄状态导致的过失犯罪无犯罪动机和目的。 (张推凤撰何为民审)
