That the regulations and methods of intelligent activities not patented,separating them from production,stands against the spirit of patent law,therefore leading to the serious deformity of patent structure,protecting not the working procedure,favouring not the whole elevation of producing technology level.

智力活动(intelleetual aeriviry)在人脑内部借助于内部言语，以简缩的形式对事物的映象进行加工改造的过程。苏联心理学家加里培林于1952年提出了他的智力活动的概念。依据人类“活动的进行所处的水平”不同，把活动分为三种:(l)“使用物质的实物”活动。(2)“使用大声的言语”的活动。(3)在“头脑中进行”的活动。他认为，智力活动是活动的一种特殊形式，是指“在头脑中进行的”活动。是借助于内部言语在头脑中默默地完成的，所以常把它称为“以词的形式在‘心里’完成的动作”。它的表现形式区别于实践活动(使用物质的实物活动)、言语活动(使用大声的言语活动)，主要特点有三:(l)观念性。实践活动的对象是具有一定物质形式的客体(实物或实物的模拟品)，智力活动的对象则是这种客体在头脑中的映象，是一种观念的活动。(2)内潜性。实践活动和言语活动都是可以觉察到的外显活动，而智力活动是在头脑中借助内部言语默默地进行的。(3)简缩性。实践活动的每个操作都必须实际作出，不能高度省略，也不能高度简缩，智力活动则可以高度省略、高度简缩，甚至察觉不到它的活动过程。 (赵欣坤撰成立夫审)
