光船租船合同由船东提供不配备船员的光船，由租船人雇佣船员，在约定期限内占有，使用船舶，并支付约定租金的租船合同，又称“空船租船合同”。光船租船合同包括传统的光船租船合同、租出租入光船租船合同和租购光船租船合同三种形式。在光船租船下，船东只保留船舶的所有权，船舶的占有权和经营权归租船人，具有财产租赁的性质。
依一般法律原则，光租合同下的各种风险承担如下：
1.船舶灭失的风险在交船时由出租人转移给租船人。
2.船舶的损失风险，在租船期间由租船人负担。
3.时间损失风险，光租中的时间损失完全在租船人。
