承包工程合同的支付条款承包工程合同中关于项目款项支付的条款，包括支付条款和付款(结算)时间。支付方式必有若干支付方式可以选择:托收、汇付、保函、信用证。承包工程较多地采用银行保函和信用证。这两种方式都是银行信用担保商业信用，风险较小，收汇有保证。对工期较长、付款次数较多的项目.采用保函方式;工期较短，一次性付款的项目采用信用证口支付期限和次数要根据项目大小、二期长短及价格等因素，由双方谈判确定，普遍采用分期付款方式，即分工程预付款、中间结算和最终结算三个步骤。预付款在签订合同后半个月(或20天)，由发包人向承包人支付，数额通常为合同总额的10%一15%，世界银行项目可不高于20%。预付款系发包人向承包人提供的无息贷款，由外汇和当地货币组成，由于购置和调拨机械、设备、材料、工地办公设施和其他为准备工程开工所需开支.发包人凭承包人从银行开具的预付款保证书支付.并按工程进度从承包人应得收益中分期扣除。中间结算(临时结算)一般每月结算一次，承包人每月末向驻地工程师提供该月完成的工程量、价格浮动调整、施工机械和材料费用，扣除承包人应支付和扣还给业主的保留金和预付款等。由工程师签发结算单，业主应在规定期限内付款.否则按合同规定增付延期付款利息‘最终结算，承包工程一般在竣工后有于-12个月的维护保证期，而每月扣留应付款的5%~10%的留存金即为维护保证金。维护期满，承包人在维护合格证书签发后数日内向驻地工程师提交项目最终结算单，工程师在收到最终结算单的一定时期内签发最终证书，业主应在签发最终证书后的30夭内付清包括留存金在内的一切款项。
