| 定金 earnest money 订立合同的一方为了证明合同的成立和保证合同的履行，在依合同应该给付的款项内预先给付对方的一定数额的金钱或其他财物。定金是债的担保的一种。如给付定金的一方不履行合同，不得请求返还定金；如收取定金的一方不履行合同，按对等原则，应加倍返还定金。如果履行了合同，定金即作为给付的一部分。定金能促使双方如约履行合同。《中华人民共和国经济合同法》第14条规定：“当事人一方可向对方给付定金。经济合同履行后，定金应当收回，或者抵作价款 。给付定金的一方不履行合同时，无权请求返还定金。接受定金的一方不履行合同的，应双倍返还定金。”《中华人民共和国民法通则》第89条也作了类似的规定。 |
