| 保外就医 released on bail for medical treatment 被判处无期徒刑、有期徒刑或拘役的罪犯因患有严重疾病，经有关机关批准取保在监外医治。监外执行的一种。有两种情况：①人民法院判决时发现罪犯患有严重疾病，不适宜在监狱或其他劳动改造场所内执行刑罚，直接决定保外就医；②罪犯在劳动改造场所服刑期间，患有严重疾病、短期内有生命危险，或者患严重慢性疾病、在劳动改造场所长期治疗无效，经劳动改造机关批准，可以保外就医。保外就医的罪犯应由罪犯所在地的公安机关监督考察。保外就医期间应计算在刑期之内。如果罪犯病已痊愈刑期未满，应收监继续执行剩余刑期；如果刑期已满，则按期释放。 |
