  Pushe haidi dianlan guandao guanli guiding《铺设海底电缆管道管理规定》(regulationson~a-gelllent ofl娜飞submanne eables and pi州ines)l卿年2月11日国务院颁布,自1989年3月1日起施行。其宗旨在于维护中华人民共和国主权和海洋权益,有序地铺设和保护海底电缆、管道,合理地开发利用海洋空间。中国海洋行政主管部门是铺设海底电缆、管道及为此所进行的“路由”调查、勘测与有关活动的主管机关。该规定在实际管理中,需根据不同管理对象和不同情况区别对待。对于中国的企业、事业单位铺设海底电缆、管道的活动,主管机关主要对其所要铺设的“路由”实施审批,以实现科学、有序的铺设和正常使用与保护;对于外国的公司、企业和其他经济组织或个人在中国的内海、领海范围内铺设海底电缆、管道以及为铺设所进行的“路由”调查、勘探活动,则必须按规定事先向主管机关提出书面申请,获准后方可实施。外国作业者在中国大陆架上进行上述活动,除应事先通知主管机关外,其最后确定的“路由”须经主管机关同意。此外,该规定对海底电缆、管道的保护、维修、改造、拆除和废弃也作了相应的规定,并将收集海底地形、海上构筑物分布等方面的资料以及提供咨询服务作为主管机关的义务加以规定。 (赵恩波)
