凡WTO章程生效时的《1974年关贸总协定》的缔约方和欧盟成员，接受该章程和各项多边贸易协定的，其各项减让和承诺表附于《1994年关贸总协定》的，且其具体承若表附于服务贸易总协定的，均应成为WTO的创始成员方。上述规定表明：原来的GATT缔约方并不当然属于WTO的创始成员方，它们还必须具备一定的条件。这些条件是：（1）它们必须按章程规定的程序和期限履行接受WTO章程和乌拉圭回合的各项多边贸易协定的手续；（2）它们必须按乌拉圭回合各项多边贸易协定做出关税减让表和各种非关税承诺表；（3）它们必须在服务贸易领域做出具体的市场准入承诺表。GATT的缔约方必须同时具备以上三个条件，才能成为WTO的成员方。
