财政法律责任担负财政法律责任的机关、单位和相对人违反财政法律义务而应当承担的财政法律后果。 建立财政法律责任制度，是维护财政法的权威性，预防财政违法行为的产生，以保障实现财政权利，履行财政义务，严肃财政纪律的客观需要。财政法律责任作为法律责任体系中的一个独立系统，它的特征主要是:1.以财政义务的存在为前提，应是担负财政法律责任的机关、单位和相对人违反财政法律义务，才承担否定性的法律后果。2.既有经济责任，又有行政责任，也就是违反财政义务的主体，应承担经济责任，同时也承担相应的行政后果，有的并要担负刑事责任。3.以维护国家财政利益，依法进行财政分配，实现国家职能为目的。但确认财政法律责任的机关，必须是能够以自己的名义，独立地作出制裁性决定的国家机关。在中国，它包括各级国家权力机关、司法机关、国务院和地方各级人民政舟、财政部、国家税务总局、海关总署、国家国有资产管理局和地方各级财政税务机关。其中财政税务机关是确认财政责任的职能机关，其工作的开展，具有普遍性。 确认财政法律责任的依据是事实和法律，要就是否有侵犯财政利益或破坏财政秩序的行为和财政法律文件，来确认担负的财政法律责任。一般财政违法行为构成的要素有:①存在财政违法行为的主体。这就是要有违反了财政法行为，并具有法定责任能力的组织单位和自然人。②存在财政违法行为的客体。这就是要有受财政法保护，但为财政违法行为所侵害的对象，包括在税收、预算、国有资产、财务、会计等各方面的对象。③具备财政违法行为的客观条件。这是在什么样的条件下，实施了什么样的违法行为，由此产生了什么徉的损害后果。这些影响到当事人担负财政法律责任的轻重。④具备财政违反行为的主观条件。这就是财政违法行为的实施人是故意实施或有过失。 国家机关违反财政法律规范也要承担法律后果，其承担方式以补救性责任措施为主。主要包括:①通报批评。即由上级机关通过文件、报刊、会议等途径，对下级机关实施的财政违法行为的事实、影响及其处理予以公布。②赔礼道歉，承认错误。有口头方式和书面方式。③恢复名誉，消除影响。可以通过会议、报刊进行，或向有关单位寄送更正决定。④返还权益，恢复原状。对违法行为剥夺了利害关系人对财产占有权及其他利益的，返还权益;变更了利害关系人财产原状的，恢复其原状。⑤停止违法行为，撤销注法决定这是由有关国家机关承担的一种惩戒性法律责任。
