| 《旧金山对日和约》 San Francisco Treaty of Peace with Japan 1951 年9月8日美、英、法等国与日本签订的片面和约。因和约在美国圣弗朗西斯科（旧金山）签订，故名。美国于1951 年9月4～8日在圣弗朗西斯科召开对日和会，单独对日缔结和约。在和约上签字的国家只有美、英、法等48国。和约除前言外，包括和平、领土、安全、政治及经济条款、要求及财产、争议之解决、最后条款等7章27条。1952 年 4 月28日生效。主要内容有：日本与各盟国之间的战争状态自条约生效时起即告终止 ；各盟国承认日本是一个主权国家，日本对领土与领海拥有完全的主权；日本承认朝鲜独立；日本放弃对台湾及澎湖列岛的一切权利和要求；将琉球群岛和小笠原群岛等置于联合国托管之下而以美国为唯一管理当局 ；日本有单独或集体自卫的权利 ， “ 可自愿加入集体安全协定”，盟国可同日本缔结双边协定，在日本驻军；放弃对日本的赔偿要求 。同一天美日两国签订了《日美安全保障条约》。 中国政府于1951年9月18日和1952年5月5日两次发表声明，拒绝承认《旧金山对日和约》。 |
