| 用益物权 usufruct 物权的一种，对他人的所有物使用和收益的权利。包括地上权、地役权、典权、永佃权等。①地上权。在他人的土地上建筑、植树的权利。建筑是指建房屋、厂房、堤坝、沟渠等固定于土地上的设施。植树指需要长期营造的竹、木等。地上权具有物权的性质和物权的一切法律特征。地上权的义务主体是不特定的，除地上权人以外的一切人(包括所有人)都是义务主体。地上权不需他人的协助就能实现，只需排除他人的干涉。地上权人还有物上请求权，并有追及效力。不论土地转让到何人手中，地上权都不受影响。②地役权。为了自己土地的便益而使用他人土地的权利。得到便益的土地叫需役地，提供邻地以便益的叫供役地。在供役地上修路通行的权利，经供役地排灌通行的权利，都属地役权。设立地役权，可以是有偿的，也可以是无偿的。设定地役权发生的需役和供役的关系，实际是一种协作关系。因此，在供役地上为必要的设置时，应当选择对供役地损害最少的处所，并采取损害最少的方法。供役地的所有人也可以使用这些设置，但应按受益程度分担必要的维修费用。③典权。典权人支付典价，占有出典人的不动产并行使使用和收益的权利。典权不同于典当，典当是一种质押借贷，是债，而不是用益物权；典权是用典物权，而不是债。土地改革后，典权在中国已不存在。④永佃权。农民支付佃租，在地主土地上永久耕种或放牧的权利。中国经过土地改革这一制度已不复存在。 |
