从公司法的角度讲，第一我国公司法没有投资公司的这样一个概念，在我国公司法中明确规定了只有有限责任公司和股份公司两种，所以，单从公司的分类上来说，不存在投资公司这样的一个类别。
第二，从公司的名称来讲，所谓投资公司，一般主要从事经贸、资产、经营类投资范围，当然主要还要看公司章程中注明的经营范围。
投资公司是以将货币或资产投向本身以外的企业或个人、并从这种货币或资产的投入取得直接经营收入或通过股份变现实现资金退出的企业法人。
目前在中国的金融市场，投资公司一般以“投资银行”的角色称呼出现，顾名思义投资公司必须拥有大量的自有资金，才能实现真正的投资运作。同时，由于投资工作本身的难度还需要另外一种类似中介性质的企业来服务投资公司和企业，因此就出现了目前市场上众多的投资顾问公司，顾问公司并不具备真正的投资能力，只是在投资活动中为项目方和资金方牵线搭桥，并从中收取顾问费用。
