司法解释是指国家最高司法机关在适用法律、法规的过程中对如何具体应用法律、法规的问题所做的解释，属于“正式解释”的一种。它包括：
1.审判解释，即最高人民法院对属于审判工作中如何具体应用法律的问题所做的解释；
2.检察解释，即最高人民检察院对属于检察工作中如何具体应用法律的问题所做的解释；
3.审判、检察联合解释，是指最高人民法院和最高人民检察院对具体应用法律的共同性问题所做的联合解释。
