补充资料:劳工保险和雇主责任保险(WorkersCompensationandEmployerLiabilityInsurance)
    指保险人对雇主依照法律或雇佣合同对受雇员工因工作遭受伤害或死亡应承担经济责任的保险。劳工保险和雇主责任保险多以法定形式实施,20世纪西方主要发达国家意外事故和职业伤害事故频繁发生,迫使广大工人为争取一定的生活福利权利而斗争,斗争的结果之一,是争取到通过立法规定雇主对其雇员在受雇期间,因意外或职业病而造成人身伤亡或死亡时,应承担经济赔偿的责任。在具体实施中各国的标准虽有所不同,但各国劳工法均规定雇主的责任为绝对责任,即对雇员的人身伤害,雇主不论有无疏忽或过失均应承担经济赔偿的责任。如果雇员的人身伤害是雇主的疏忽所致,雇主还应承担根据民法应承担的经济责任,但这应在保险人赔付之前雇员或其家属已提出起诉,并证明雇主有过失。雇主责任险是逐年投保,保费按工资总数及规定的不同工种的费率计算,并打入企业生产成本。在当今社会,一方面,投保雇主责任保险是雇主应尽的法律义务;另一方面,雇主通过缴纳固定的保险费,将雇员遭受意外伤害时的赔偿责任转嫁给保险公司,避免了可能产生的经济纠纷,有助于企业的经济核算,从而也保障了雇主的利益。
