行政行为依法实现的方式、步骤与过程。方式指行政行为的空间表现形式;步骤指行政行为的时间顺序;过程指行政行为的持续状态。学术界对行政程序的认识不尽相同，主要有以下几种理解：①指行政权行使或行政事务处理的过程与步骤；②指行政机关行使其权力时必须遵循的程序；③指行政机关实施行政处分及行使其他公共权力时,应遵循的手续;④指行政机关实施行政法律行为的过程。行政行为的复杂性、变异性和多样性，决定了行政程序概念的不确定性。每个国家的行政程序都有各自的调整范围。由于任何行政行为都通过一定的空间和时间的形式表现出来，因此，它客观地表现为一定的程序。但并非所有的程序都能准确、迅速地实现行政目标，这就有必要制定一些带有强制性的规范，如行政程序法的制定和实施，对行政行为的方式、步骤与过程加以约束、引导和选择。不是所有的行政程序都由法律来规定，究竟何种行政行为需要用强制性的法律来规范，或者需要在何时规范，取决于各国的实际情况。
