地震保险承保方式
【地震保险承保方式】有法定保险、自愿保险、综合财产保险、自愿保险与法定保险相结合的四种地震承保形式。日本根据地震保险法实行的承保方式，起初规定在火灾保险上“自动附加”、原则上自愿附加，1950年7月修改地震保险制度时统一为“原则上自动附加”一种，即在订立火灾保险契约时，只要投保人没有表明不参加地震保险，则确认保地震保险。中国究竟采用哪种承保方式，说法不一。有的主张对强震区的国有企业财产施行法定保险，其他采取自愿保险，实行以自愿保险为主、法定保险为辅的原则，扩大保险覆盖面，发挥地震保险的补偿作用;有的主张实施全面的法定地震保险，为国家迅速建立起一笔后备基金，采用被保险人自负一定损失方式减轻保险费负担，并按地震带、建筑物考虑费率的合理结构;有的主张维持现行做法，地震仍放在财产保险综合责任内，但应建立适度的地震保险基金;有的主张在财产保险综合责任中剔除地震，作为一种“原则上自动附加”的地震保险来承保。目前财产保险综合险条款中已把地震作为除外责任。
