经济合同鉴证鉴证经济合同是工商行政管理部门特有的一项合同管理职责，是经济合同管理的一项重要内容。它是指工商行政管理机关依据经济合同双方当事人的申请，依法证明合同的真实性和合法性的活动。其作用表现在：可以指导当事人签订合同，防止和减少合同纠纷，提高合同履行率，发现和制止利用经济合同进行违法活动，维护社会经济秩序等。我国经济合同的鉴证实行自愿原则。经济合同鉴证不是经济合同有效成立的必要条件，只要双方依法就经济合同的主要条款经过协商一致，合同就成立，同鉴证与否无关。当事人认为有必要鉴证的，可以按照合同约定，或事后达成的协议，到工商行政管理部门申请鉴证。
经济合同鉴证的内容主要是审查经济合同当事人是否合格，即是否具有相应的权利能力和行为能力；经济合同当事人的意思表示是否真实、清楚；经济合同的主要内容是否符合国家的法律、法规和政策的要求；经济合同的主要条款内容是否完备；文字表述是否准确；合同的签订是否符合法定程序。经济合同的鉴证一般由合同签订地或合同履行地工商行政管理机关负责办理。申请时，需双方共同提出，并提供经济合同正本、副本，营业执照或副本，鉴订经济合同的法定代表人或委托代理人资格证明以及其他有关的证明材料。经鉴证人员审查，认为符合要求的，予以鉴证，并由鉴定人员在合同文本上签名，加盖工商行政管理局的经济合同鉴证章。对于当事人提供的材料不完备或不合法的，应告知当事人子以补正或纠正，或不予鉴证。鉴证完毕，当事人双方应缴纳鉴证费。
