1 iben nongtian boohu tiaoli《基本农田保护条例》(珍，lations for ftlndamen以伪叮日朋dc~rvation)中国调整耕地保护关系的行政法规。国务院1望抖年8月18日发布，自1望科年10月l日起施行。共6章40条。主要内容有:①基本农田目标管理责任制。县级以上地方各级人民政府应将基本农田保护工作纳人国民经济和社会发展计划，作为政府领导任期目标责任制的重要内容，由上一级人民政府监督实施。②划定基本农田保护区。将粮、棉、油和名、特、优、新农产品生产基地，高产稳产农田，大中城市蔬菜生产基地，农业科研、教学试验田等划人保护区予以特殊保护，并设置保护标志，予以公告。③基本农田保护。占用基本农田必须报县级以上人民政府批准。占用一级基本农田5《X)亩以上的，必须报国务院批准;5(X)亩以下的，必须报省级人民政府批准。同时，占用者还必须承担开垦新耕地的义务或者按规定缴纳造地费，禁止在基本农田保护区内建窑、建房、建坟或者擅自挖沙、采石、采矿、取土、堆放固体废弃物，禁止擅自将基本农田转为非耕地和闲置、荒芜基本农田。④监督管理。上级人民政府应当与下级人民政府，乡级人民政府应当与农村集体经济组织或者村民委员会签订基本农田保护责任书，并定期进行监督检查。⑤罚则。对违反本条例规定，未经批准或非法批准占用基本农田保护区耕地，破坏或者擅自改变基本农田保护区的保护标志，在基本农田建窑、建房、建坟或者擅自挖沙、采石、采矿、取土，严重毁坏种植条件等违法行为，分别规定了相应的法律责任。(展瑰奇)
