The Vienna Convention Civil Liability for Nuclear Damage
《核损害民事责任维也纳公约》(The ViennaConvention Civil Liability for NuelearDamage)一项有关核损害第三方责任的国际公约。1963年5月19日经在维也纳举行的关于核损害民事责任的国际大会通过，1963年5月21日开始签字，1977年11月12日生效，截至1993年底，共有20个缔约国。 《公约》的主要内容有4’点:①当发生核事故而对第三方造成核损害时，核设施的经营者负有绝对的赔偿责任，核设备的供应者或造成事故的操作人员不承担任何赔偿责任;②对于一次核事故所造成的核损害，核设施的经营者对全体贫害灭赔德函意颧是看限的。赔偿的责任期为10年;③核设施的经营者必须用保险费或其他财政保证金承担其责任;④对核损害的应赔总额如果超过经营者的最高赔偿额，国家应提供有限的财政补偿。 鉴于前苏联切尔诺贝利核事故的严重后果，为了完善现有国际核损害责任制度，以建立对特大核事故的受害者提供充分和及时的赔偿机制，按照国际原子能机构第32届大会491号决议，机构理事会于1989年2月决定成立工作组(后改为核损害责任常设委员会)，审议核损害责任所有方面的问题，包括国际国家责任问题，以及国际民事核责任制度和国际国家核责任制度的关系。核损害责任常设委员会已就《公约》条款涉及的范围、军事核设施的适用性、核损害定义、免责、索赔程序、财政限额等1。多个问题提出了修订条文。常设委员会已建议《公约分缔约国召开外交大会，审议通过经修订的《核损害民事责任维也纳公约》。 (李东晖)
