At persent,in China\'s "Criminal Law","illegally attract deposits from the public crime" has no clearly explaination and related legal interpretation,which is set for the judiciary\'s practice some obstacles.

In accordance with China\'s existing laws,rules and regulations,it is not proper in the sense of legitimate reason to regard all the rule-breaking monetary management with guaranteed minimum return offered by financial institutions as the crime of illegal absorbing public savings.

Illegal financing activities are highly incident cases in judicial proceedings, these cases are mainly investigated into criminal responsibility by the Crime of Illegal Pooling of Public Savings Deposits,which provided in article 176 of Criminal Law.
