补充资料：比较国际私法学派
第一次和第二次世界大战期间产生的一个新的国际私法学派，在第二次世界大战以后有了一定程度的发展。德国称它为"第三学派"，以别于普遍主义－国际主义学派和特殊主义－国家主义学派。这个学派以德国的E.拉布尔、H.莱瓦尔特、L.拉珀、M.沃尔夫和法国的莫里为主要倡导人。他们摒弃了普遍主义者所采用的建立先验的国际私法理论体系的方法，也否定了法律抵触即是主权冲突，以及国际私法的任务在于解决主权冲突的观念，而把重点放在就每一类法律关系寻求对当事人最公平最妥当的准据法的问题上。他们从肯定各国有不同的抵触规则同时并存的事实出发，采取比较方法进行研究，以期发现其异同，并予以协调，甚至统一。所以该派也可以被称为未来的普遍主义学派。特别是在制订统一的国际私法条约，如海牙国际私法会议的一些条约中，该派取得了相当的成就。此外，该派学者还致力于实体法的比较研究，以协调法院地法（即内国法）与外国法的适用。例如，1951年以来由很多学者合著了一部十多卷本的著作，是关于美国国际私法与其他国家国际私法的比较研究。拉布尔的4卷本《法律抵触:比较研究》是这个学派迄今最重要的代表作。
