一条是现行刑法对绑架罪的规定,它分为两个方面:首先是把“致使被绑架人死亡或杀害被绑架人”作为绑架罪的加重情节写入绑架罪的罪状中;其次绑架罪的法定刑非常严厉,在《刑法修正案(七)》通过之前,其法定最低刑为十年有期徒刑,即使《刑法修正案(七)》把绑架罪的法定最低刑降至五年有期徒刑,绑架罪的刑罚相比较其他暴力犯罪而言也依然严厉。
