海外投资保险制度是指在政府支持下，对本国海外投资实行的一种商业保险制度，又称“投资保证制度”。旨在鼓励和促进资本输出。它包括两类，一是单边的保险制度，即海外投资者不论本国是否与东道国签订有双边投资保护协定，均可在国内申请投资保险。二是双边的保险制度，是以接受投资国同本国定有双边投资保护协定为前提，即本国私人海外投资者只有在有海外投资保护协定的国家投资，才能在国内申请投资保险。
