  【房产转移登记】指在总登记以后,所有权发生继承、买卖、划拨、投资、征购、收购、赠与、交换、转让等情节,涉及到房屋所有权变更时,必须办理产权过户手续。办理产权转移登记须按下列需要提交证件:(l)购买房屋,须提交原房屋产权证、买卖合同、有关上级的批准文件和契约;(2)受赠房屋须提交双方房屋产权证、赠与书和契证;(3)交换房屋须提交双方房屋产权证、协议书、有关上级的批准文件和契证;(4)继承房屋须提交原房屋产权证(或遗产继承证件)和契证;(5)分家折产、分割的房屋,须提交原房屋所有权证、分家折产单或分割单和契约;(6)调拨、接管的房屋,须提交调拨文件、移交清册和有关证件。证件不全或房屋所有权不清楚的,暂缓登记,待条件成熟后办理。有下列情形之一者,不能办理产权转移登记:(l)国有房屋的使用单位或个人,私自改变使用性质、私自转移变更或转租的;(2)原房屋产权来源确认为合法的或产权有纠纷未予处理定案的;(3)经当地房管部门或人民法院裁定限制产权转移的房屋。房产转移登记须经过登记文件、产权审查、重新绘制权证、收费发证等工作程序。转移登记是有一定期限的,逾期不办或拒不办理的,不论单位或个人,都需给予必要的处罚。同时,产权发生纠纷时,一般房管机关不予仲裁,人民法院不予受理,国家建设征用拆迁时,可按违章建筑处理,不予补偿、产权转移登记是一项经常性工作,目的是及时掌握所有权的变动,确定新的所有权人的权利,修正原有的产籍资料,是一种动态登记。
