[农村集体土地建设用地使用权确认】1.乡(镇)村办企事业单位和个人依法使用农村集体土地搞非农业建设的，可依法确定使用者农村集体土地建设用地使用权，对于其中的闲置部分不予确定使用权;2.全民或城市集体所有制单位与农民集体、农民集体与农民集体联办的企事业单位使用的集体土地，只作为联营条件，未给予土地补偿或安置劳动力的，可确定联办企事业单位的集体土地建设用地使用权;3.1982年2月《村镇建房用地管理条例》公布之前，农村居民建房占用的宅基地，及之后未经拆迁、改建、翻建的，原则上按现有实际使用面积确定集体土地建设用地使用权;4，1982年2月《村镇建房用地管理条例》公布至1987年1月《土地管理法》开始实施时止，农村居民建房占用的宅基地，其面积超过当地政府规定标准的，超过部分按1986年3月中共中央、国务院《关于加强土地管理，制止乱占耕地的通知》及地方政府的有关规定处理后，按处理后的实际面积确定集体土地建设用地使用权;5.凡符合当地政府分户建房规定而尚未分户的农村居民，其现有宅基地在没有超过分户建房用地合计面积标准的，可按现有宅基地面积确定集体土地建设用地使用权;6.非农业户口居民原在农村的宅基地，凡房屋产权没有变化的，可依法确定其集体土地建设用地使用权;7，通过房屋继承取得的宅基地，继承者拥有使用权;8.接受转让或购买房屋取得的宅基地，与原有宅基地合计面积超过当地政府规定标准的，按有关规定处理后再确定集体土地建设用地使用权;9.集体或个人代管的华侨房屋占用的土地，其集体土地建设用地使用权暂时确定给代管者，以后房屋按政策退还华侨本人时，再变更集体土地建设用地使用权;ro.农村专业户宅基地以外的非农业建设用地用宅基地分别确定集体土地建设用地使用权;11.按照上述意见确定的农村居民宅基地的集体土地建设用地使用权，凡超过当地政府规定面积标准的，以后房屋拆迁、改建、翻建时，按当地政府规定的面积标准重新确定使用权，其超过部分退还集体。
