为了维护劳动合同当事人,特别是维护在劳动关系中处于弱势地位的劳动者的利益,在劳动合同立法中要坚持无固定期限劳动合同为主,有固定期限合同为辅的原则,突出无固定期限劳动合同的地位,承认口头劳动合同的法律效力,在劳动者预告解除劳动合同权利的期限上要根据劳动者的不同身份和地位,分别作出不同期限的规定,同时应将无条件的预告解除权平等地授予用人单位。

Under the background, China has implemented two kinds of human resource laws recently: Labour Contract Law and Employment Advancement Law, which aim to regulate the development and management of human resources.

苏联最高苏维埃于1969年7月11日通过,1969年11月1 日起施行。该立法纲要是各加盟共和国制定劳动改造法典的立法基础。包括5章,49条。各章分别对劳动改造立法的任务,执行剥夺自由、流放、放逐和不剥夺自由的劳动改造等刑罚的一般规定,执行剥夺自由刑罚的程序和条件,流放、放逐、不剥夺自由的劳动改造等刑罚的程序和条件,免予服刑的理由,以及对从剥夺自由的场所释放的人的帮助和对他们的监督等作了规定。苏联最高苏维埃主席团于1973及1977年,曾数次发布法令,对《劳动改造立法纳要》进行补充和修改。
