特殊侵权行为，是指由法律直接规定，在侵权责任的主体、主观构成要件、举证责任的分配等方面不同于一般侵权行为。应适用民法上特别责任条款的致人损害的行为。在我国民法通则中，属于特殊侵权行为的情况都有具体的条文明确加以规定。
特殊侵权纠纷包括十四种情形：
1.国家机关及其工作人员职务侵权纠纷；
2.雇员受害赔偿纠纷；
3.雇佣人损害赔偿纠纷；
4.产品责任纠纷；
5.高度危险作业致人损害纠纷；
6.环境污染损害赔偿纠纷；
7.地面（公共场所）施工损害赔偿纠纷；
8.建筑物、搁置物、悬挂物塌落损害赔偿纠纷；
9.堆放物品倒塌损害赔偿纠纷；
10.动物致人损害赔偿纠纷；
11.驻特别行政区军人执行职务侵权纠纷；
12.防卫过当损害赔偿纠纷；
13.紧急避险损害赔偿纠纷；
14.侵害未成年人接受教育权纠纷。
因以上14种情形导致的致人损害的行为就可能引发特殊侵权纠纷。
