| 自首 voluntary surrender 犯罪事实或犯罪人被发觉前，犯罪人主动向司法机关告知自己犯罪的事实并表达出愿意接受审判的意思表示。中国古代称为自告。 自首必须具备2个条件：①犯罪后自动投案 。即犯罪事实未被发觉而自动投案的；犯罪事实已被发觉，但尚未发现犯罪分子而自动投案；犯罪事实和犯罪分子虽被发觉，但犯罪分子尚未受到讯问、未被施以强制措施，而自动投案；犯罪后逃跑，在通缉、追捕中，自动投案的；确已准备去投案或在投案途中被捕获，经查属实的；经家长、亲友规劝，陪同投案的，按投案自首对待；被采取强制措施的犯罪嫌疑人、被告人和正在服刑的罪犯，如实供述司法机关还未掌握的本人其他罪行的。②如实交代所犯罪行。即指犯罪分子自动投案后全部交代自己罪行，或者如实交代自己的主要犯罪事实；共同犯罪案件中，犯罪分子除交代自己的罪行外，还交代所知的同案犯，主犯必须揭发同案犯的罪行；只交代次要罪行，或者只交代自己罪行而掩护同案犯，都不算是如实交代。 自首与坦白是有区别的。犯罪分子在有关组织或司法机关已发觉其犯罪事实，对其进行询问、传讯或者采取强制措施后，如实交待自己罪行的行为是坦白。自首是法定的从轻、减轻或免除刑罚的情节。坦白是量刑时酌定从宽的情节。 中国刑法规定，犯罪以后自首的，可以从轻或者减轻处罚。其中犯罪较轻的，可以免除处罚。 |
