I产权分割】二人以上共有房产或夫妻离婚、兄弟、姊妹分家所发生的产权劈分。所分房产必须是分产人所共有。但每人分得的房屋价值并不一定恰恰相当于所占份额。在分家、分伙的同时，还往往连同其他财产一起划分。因而也会出现房产共有人中有的分得房产，有的分得其他财产物的现象。·以上两种情况，不论共有之间有无互相补价，在确定房产时，均予以承认，准其按分产办理房产登记，并不征契税。产权分割后，要办理产权变更登记才能取得合法产权。
