(3)由上市公司或其关联公司持有10%以上股份的证券经营机构自营买卖该上市公司的股票。 (4)将自营业务与代理业务混合操作。 (5)以自己名义为他人或以他人名义为自己买卖证券。 (6)委托其他证券经营机构代为买卖证券。 (7)其他违反自营业务管理法规的行为。 5.证券经营机构有下列行为之一的，视情节轻重，单处或并处警告、没收非法所得、5万元以上50万元以下罚款、暂停自营业务半年至一年、取消自营业务资格，并在两年内不受理自营业务资格申请: (l)以欺骗或其他不正当手段获得证券自营业务资格。 (2)从事或参与内幕交易和操纵市场行为。 6.证券经营机构屡次违反本办法，在一年的时间中受到警告、没收非法所得、罚款的处罚累计达3次以上，或受到暂停自营业务处罚累计达2次以上，取消自营业务资格，并在两年内不受理自营业务资格申请;情节严重的，可同时暂停或停止其他证券业务。 7.证券经营机构涉嫌严重违法违规或严重亏损，在被证监会或国家有关部门调查期间，可以暂停其证券自营业务资格，暂停时间最长不超过半年，并根据调查结论作相应处理。【资格证书】证监会确认可以进行证券自营业务资格后颁发“经营证券自营业务资格证书”，该证书自证监会签发之日起一年内有效，一年后自动失效，所以，应在“经营证券自营业务资格证书”快到期时(一般是失效前的3个月内)向证监会报送有关材料，经证监会审核通过后换发资格证书。 《证券经营机构证券自营业务管理办法》第6章罚则规定: 1.证券经营机构在取得资格证书前或在资格证书失效后从事或变相从事证券自营业务的，单处或并处警告、没收非法所得、3万元以上30万元以下的罚款。 2.证券经营机构违反本办法第18条、19条、24条规定，又不作及时调整和建立相应风险控制制度的，处以警告，并限期纠正;在限期内仍达不到规定要求的，处以暂停自营业务资格半年至一年的处罚。 3.证券经营机构违反本办法第20条、21条、22条规定，单处或并处警告、没收非法所得、3万元以上30万元以下罚款，并限期纠正;在限期内仍达不到规定要求的，处以暂停自营业务资格半年至一年的处罚。 4.证券经营机构有下列行为之一的，视情节轻重，单处或并处警告、没收非法所得、3万元以上30万元以下罚款、暂停自营业务资格半年至一年的处罚: (l)不接受、不配合证监会的检查、调查。 (2)不按规定上报自营业务资料和情况报之七‘口O
