Abstract: Compared with administration and legislation, the character of termination is an important feature of judiciary; this character is an inner requirement of judicial authority, authority oflaw as well as rule of law; To carry out the terminative character of judiciary, it is necessary to makejudicial reform.

Based on the characteristics of college learning, an objective, practical and continually optimized assessing system should be formed with the combination of summative assessment and formative assessment.

Based on the differences between formative assessment and summative assessment,the paper points out the characteristics and backwash effect of traditional assessment system of college English,analyzes the relationship between formative assessment and the cultivation of students autonomous learning ability.

In the present assessment system in College English teaching and learning,summative assessment that unilaterally emphasizes the result has many side-effects,however,formative assessment that lays emphasis on the process of learning is profitable to enhance students ability of autonomous learning and the comprehensive application of English,and promote the overall development of students.
