As the commencement of Property Law legislation should base on the issues,not on the models,the legislation should emphasize the investigation,and properly handle the relationship of "localization of law" and "reference and transplantation of law".
我国物权法应以普通民众为话语对象,故立法用语应通俗而规范;物权立法的启动不应从模式而应从问题出发,故立法应注重调查研究,妥善处理“法的本土化”与“法的借鉴和移植”之间的关系;借鉴与移植物权制度既要全面(即两大法系都有可借鉴之处),又要重点突出(即应基本定位于大陆法系),还要关注俄罗斯物权立法经验。
