| 录囚 皇帝和各级官吏定期或不定期巡视监狱，对在押犯的情况进行审录，以防止冤狱和淹狱，监督监狱管理的执行司法制度。是中国古代监狱史和司法制度史上的一项重要制度。又称虑囚。西周时期就有司法官吏每年仲春三月省视监狱的制度。西汉王朝建立以后，鉴于秦朝法峻刑残，囹圄成市而激起人民反抗的历史教训，吸取儒家的慎罚思想，对司法制度多有改革，并在此基础上建立录囚制度，但当时仅限于州郡刺史太守定期巡视所部狱囚。皇帝亲录囚徒，盛起于东汉，并为历代王朝所重视，从而使录囚制度成为朝廷监督全国司法状况的重要手段。唐代，录囚制度有所发展并趋于完备，皇帝亲录囚徒成为不废之常典，录囚已成为地方长官和狱官的重要职责和实行赦宥的固定制度。明清两代盛行会官审录之制，皇帝一般不再亲录囚徒。如明代每五年命司礼太监会同三法司堂上官，于大理寺审录囚徒，称为大审。会官审录在司法制度史上是审判、复核制度在中国古代社会晚期的重要表现形式，但它与录囚的性质、任务大体相同，是录囚制度发展演变的结果。有的朝代还采取录囚的形式释放大批囚犯。 |
